Overview

Idyl Spaces (idylspaces.com) is operated by ECOM X HUB LIMITED, a company registered in the United Kingdom (company number 17240767). In these Terms of Service ("Terms"), "Idyl Spaces", "we", "us" and "our" refer to that company, and "you" refers to anyone who visits our website or buys from us.

These Terms apply whenever you browse idylspaces.com, place an order or use any feature of our online store (together, the "Service"). They should be read alongside our Shipping Policy, Return & Refund Policy, Privacy Policy and Payment Policy, which form part of these Terms.

By using the Service or placing an order, you agree to these Terms. If you don't agree with them, please don't use our website.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell our products to you.

Section 1 – Using our store

To place an order, you must be at least 18 years old, or be using the Service with the involvement and consent of a parent or guardian.

You agree not to use our products or the Service for any unlawful purpose, or in a way that breaches any law that applies to you, including intellectual property laws.

You must not upload or transmit viruses, malware or any other harmful code.

If we reasonably believe you have seriously breached these Terms, we may suspend or end your access to the Service.

Section 2 – General conditions

We may refuse service on reasonable grounds, for example where we suspect fraud or misuse of the Service. Your payment information is always encrypted when transmitted, although other content you submit may pass across various networks in the course of normal website operation.

You may not copy, reproduce, resell or otherwise exploit any part of the Service or our website content without our written permission. Headings in these Terms are for convenience only and do not affect their meaning.

Section 3 – Accuracy of information

We take care to keep the information on our website accurate and up to date. Some content, such as styling ideas or general guides, is provided for general information only.

Occasionally, errors may occur. If a mistake affects an order you've placed, we'll contact you and give you the choice of continuing with the correct details or cancelling for a full refund.

Section 4 – Prices and changes to the Service

All prices are shown in Australian dollars (AUD) and include GST where it applies. We may change prices, products or features of the Service from time to time. Price changes will not affect orders that we have already confirmed.

Section 5 – Products

Some products may be available only online or in limited quantities. Returns and refunds are handled in line with our Return & Refund Policy and the Australian Consumer Law.

We aim to show product colours, finishes and materials as accurately as possible, but the way colours appear depends on your screen, so slight differences may occur. Product dimensions are given as a guide, and small variations can occur with natural materials and handcrafted items. We recommend measuring your space before ordering.

We may limit the quantity of any product available per order or per customer, and we may discontinue products at any time. Our products come with the consumer guarantees set out in the Australian Consumer Law, including that they will be of acceptable quality, fit for their stated purpose and match their description.

Section 6 – Orders, billing and account information

When you place an order, you're making an offer to buy. Your order is accepted when we confirm it by email. We may decline or cancel an order, or limit quantities, where a product is unavailable, a pricing or description error has occurred, we cannot verify payment, or we reasonably suspect the order is fraudulent or intended for commercial resale. If this happens, we'll let you know using the contact details you provided and refund any payment in full.

You agree to provide current, complete and accurate information for all purchases, and to update your details, including your email address and payment information, so we can complete your order and contact you when needed.

Section 7 – Optional third-party tools

We may give you access to third-party tools that we do not operate or control. These tools are provided by their own providers under their own terms, and we recommend you review those terms before using them. To the extent permitted by law, we are not responsible for third-party tools.

Any new features or tools we add to the Service in future will also be covered by these Terms.

Section 8 – Third-party links

Our website may include content or links from third parties. We don't control third-party websites and aren't responsible for their content, products or services. Please review a third party's terms and policies before making any purchase from them, and direct any questions about their products to them.

Section 9 – Reviews, comments and submissions

If you send us reviews, comments, ideas or other material (together, "submissions"), you allow us to use, edit for length or clarity, reproduce and publish them in any medium, without payment to you. We're not obliged to keep submissions confidential or to respond to them.

Reviews must reflect your genuine experience. We don't remove or hide reviews simply because they're negative, and we won't edit a review in a way that changes its meaning. We may remove submissions that are unlawful, offensive, threatening, defamatory, obscene, infringe someone else's rights or otherwise breach these Terms.

You agree that your submissions will not infringe anyone's rights, contain unlawful or abusive material, or include malicious code, and that you won't use a false identity or mislead anyone about who you are. You are responsible for your own submissions and their accuracy.

Section 10 – Personal information

Any personal information you provide through the Service is handled in line with our Privacy Policy.

Section 11 – Errors and omissions

Our website may sometimes contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping times or availability. We may correct these at any time. Where a correction affects an order you've already placed, Section 3 applies.

Section 12 – Prohibited uses

In addition to the other restrictions in these Terms, you must not use our website or its content:

For any unlawful purpose, or to encourage others to act unlawfully
To breach any law, regulation or rule that applies to you
To infringe our intellectual property or anyone else's
To harass, abuse, defame, threaten or discriminate against any person
To provide false or misleading information
To upload or spread viruses or other malicious code
To collect or track other people's personal information
To spam, phish, scrape, crawl or carry out similar automated activity
For any obscene or offensive purpose
To interfere with or bypass the security features of the Service

We may suspend or end your use of the Service if you engage in any prohibited use.

Section 13 – Consumer guarantees and limitation of liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those guarantees or any other right you have under that law.

Subject to your rights under the Australian Consumer Law, we don't guarantee that the website will always be available, uninterrupted or free from errors. We may temporarily suspend the website for maintenance or for reasons outside our control.

To the extent permitted by law, we are not liable for any loss or damage that was not reasonably foreseeable, or that was not caused by our failure to comply with these Terms or the law. We are not liable for business losses, such as lost profits or revenue, as our products are supplied for personal and household use.

Section 14 – Your responsibility

You are responsible for any loss, claim or cost, including reasonable legal costs, that we incur to the extent it is caused by your breach of these Terms, your misuse of the Service, or your infringement of any law or third-party right.

Section 15 – Severability

If any part of these Terms is found to be unlawful, void or unenforceable, that part will be applied to the fullest extent the law allows, and the remaining parts will continue in full effect.

Section 16 – Termination

You can stop using the Service at any time. We may suspend or end your access if we reasonably believe you have seriously breached these Terms, and where practical we'll let you know first.

Ending your use of the Service doesn't affect orders already completed, obligations that arose before termination, or your rights under the Australian Consumer Law.

Section 17 – Entire agreement

If we don't enforce any part of these Terms straight away, we can still enforce it later.

These Terms, together with the policies referred to in them, are the entire agreement between you and us about your use of the Service, and replace any earlier versions.

Section 18 – Governing law

These Terms are governed by the laws in force in Australia, including the laws of the state or territory in which you live. You may bring any dispute before the courts of that state or territory.

Section 19 – Changes to these Terms

The current version of these Terms is always available on this page. We may update them from time to time, for example to reflect changes in the law or how we operate. The Terms in force when you place an order are the ones that apply to that order.
